Tricolor TV summarized the results of the antipiracy activities in 2016

Tricolor TV, the major Russian operator of digital television, continues the largescale antipiracy campaign in Russia and countries of the near abroad. 15 criminal and 19 administrative proceedings were commenced, 1,070 Internet resources were blocked over the reporting period. The effectiveness of the antipiracy campaign is contributed by the assistance of representatives of law enforcement agencies as well as new legislative initiatives.

The results of the antipiracy activities of Tricolor TV in 2016 have been summarized. Within the disrupting the illegal activities of connecting individuals to digital television services by installing pirated equipment and malicious software 25 facilities of piracy activities were identified and the information about them was transferred to law enforcement agencies for investigative operations and making the decision about subsequent criminal prosecution. In the process of the criminal investigation the officers of law enforcement agencies seized over 130 units of pirated equipment used in the unlawful activities (23 pirated receivers, 57 smart cards, 9 personal computers and 6 programmers, 20 chips and cryptomodules, etc.).

15 criminal proceedings were commenced in Russia and the CIS countries: seven of them were taken to court. The verdicts of guilty were delivered in all the seven cases: four in Russia and three in the Republic of Belarus. Investigation is under way on four more cases.

The company continues active working on disrupting the legal offences in the area of card sharing*. One more verdict of guilty was delivered to a citizen of the Russian Federation who fraudulently connected users to pirated services.

Another important area of antipiracy activities of Tricolor TV is restraint of violations of copyright and associated rights. The operator identifies cases of illegal broadcasting of television channels in public places (cafes, waiting rooms of transportation hubs, sport clubs, hotels, etc.), i.e. without conclusion of agreement for the right to public and room demonstration by the legal entity. In 2016 the inspections conducted by the company’s employees jointly with representatives of the Procurator’s Office and the MIA resulted in initiation of 19 administrative proceedings. In 18 of them administrative punishment was imposed. Within the frames of pre-trial work 12 agreements were concluded with the right to public and room demonstration, which exceeded the indicator of 2015 twice. As of the end of the reporting period 29 more applications for bringing legal entities to administrative responsibility are pending at law enforcement agencies.

It should be necessary to note separately the violations in the field of copyright and associated rights made by cable and IPTV operators illegally rebroadcasting the content of Tricolor TV. In 2016 four violations were identified. Within the frames of the pre-trial work two infringers concluded settlement agreements with Tricolor TV, and the rights holders of Tricolor TV were compensated for the inflicted damage; the amends has already been transferred to the company’s account. Applications for bringing two more operators to criminal responsibility are pending.

In 2016 special attention was paid to fighting against pirated websites offering unlawful access to satellite television channels. In the reporting period 1,070 Internet resources were blocked upon the operator’s request, which is 32% more than last year. Tricolor TV succeeds in settling the issues of unlawful use of its trademark through a pre-trial process.

Piracy activities are damaging both for pay television operators and content producers and, eventually, for consumers because as distinguished from pirates the rights holder and the operator are responsible for the quality of the content and services provided. Owing to improvement of technologies, including the technologies of satellite signal transmission and cryptoprotection ensuring the maximum copy protection as well as due to the joint efforts of the industry players and representatives of law enforcement agencies the anti-piracy in Russia strengthens the positions of the license market. In 2016 industry associations and government representatives put forward a number of legislative initiatives aimed at regulation of the industry, improvement of the mechanisms of blocking the resources with unlicensed content. In particular, the Government of the RF has recently introduced amendments for consideration by the State Duma to Law No. 149-FZ «On Information, Information Technologies and Protection of Information» for the first time introducing the wording of the notion of «a mirror», a derived website. These measures are aimed at stimulation of consumption of legal content in Russia, development of «video on demand» services and the digital market in general.

Nevertheless, the high level of the piracy threat in Russia still hinders development of a single digital media market. More resolute actions are necessary both on the part of the state and on the part of the industry community. A good example is the recent events in Great Britain where Google and Bing search engines have signed a voluntary code of norms according to which the positions of the websites with pirated content are to be declined. Only joint work of all leaders of the digital market — operators, content producers and search engines — will bring anti-piracy to a fundamentally new level.

* Card sharing is a widely spread pirate scheme based on installation of satellite equipment for unauthorized persons; besides, malicious software is installed on the satellite receiver which connects the receiver with a pirated server via Internet. To operate card sharing the server owner has to make regular payments for its services, usually in the dollar equivalent.
